These Terms of Service govern your use of Aquila VPN, a service provided by Tachyon Networks Limited, ROOM 12, 6 FLOOR, THE CLOUD, 111 TUNG CHAU STREET, TAI KOK TSUI, KOWLOON, HONG KONG.

1. Acceptance of Terms

By accessing or using Aquila VPN, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Tachyon Networks Limited in relation to Aquila VPN.

2. Service Description

Aquila VPN provides a virtual private network (VPN) service intended to enhance online privacy and security by encrypting internet traffic and routing it through VPN infrastructure. Features, performance, coverage, and availability may vary by platform, device, location, payment channel, or technical limitations. We may modify, improve, suspend, or discontinue parts of the Service from time to time.

3. Account Registration

To use the Service, you may need to create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for activities that occur under your account. You must promptly notify us of any unauthorized use of your account.

You agree not to use Aquila VPN for unlawful, abusive, or prohibited activities, including but not limited to:

We may investigate suspected violations and may suspend, restrict, or terminate accounts that violate this Acceptable Use Policy or create legal, operational, or security risk for us, our providers, or other users.

5. Subscription and Payment

Aquila VPN may offer subscription-based plans through our website or through third-party billing channels such as Stripe, Apple Pay, Google Pay, the Apple App Store, or Google Play. By subscribing, you agree to pay the fees, taxes, and charges associated with your selected plan and billing channel. Pricing, billing currency, renewal timing, and payment terms may vary depending on where and how you subscribe.

5.1 Auto-Renewal

Unless otherwise stated at the time of purchase, subscriptions may automatically renew at the end of each billing period until cancelled. If you purchased through a third-party platform, renewal and cancellation are governed by that platform's billing rules and tools. Cancellation generally takes effect at the end of the then-current billing period unless otherwise required by applicable law or platform policy.

5.2 Refund Policy

Refund eligibility, timing, and processing may depend on the payment channel you used. Purchases made through our direct payment providers may be eligible for refunds in accordance with the refund terms presented at checkout or in a separate refund policy. Purchases made through third-party platforms, including the Apple App Store or Google Play, are generally subject to those platforms' refund rules and procedures.

We may change subscription prices, plan features, trial offers, or billing structures from time to time. Where required, we will provide notice in advance through the Service, by email, or through the applicable billing platform. Continued use of the Service after a price or plan change takes effect constitutes acceptance of the updated pricing or plan terms.

6. Intellectual Property

All content, software, trademarks, logos, service marks, and other intellectual property associated with Aquila VPN are owned by us or our licensors and are protected by applicable law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your personal or internal business use. You may not copy, modify, distribute, reverse engineer, resell, or create derivative works from the Service except as permitted by applicable law or with our prior written permission.

7. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. We do not guarantee that the Service will be uninterrupted, error-free, available in every location, completely secure, or suitable for every purpose. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except to the extent such disclaimers are prohibited by law.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Aquila VPN and its affiliates, officers, employees, contractors, licensors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, business, data, use, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Service, even if advised of the possibility of such damages.

To the fullest extent permitted by applicable law, our aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid us for the Service during the twelve (12) months preceding the event giving rise to the claim, or USD $50 if you did not make any payment to us during that period.

9. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Aquila VPN and its affiliates, officers, employees, contractors, and agents from claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your misuse of the Service, your violation of these Terms, or your violation of any law or third-party rights.

10. Termination

We may suspend, restrict, or terminate your access to the Service if we reasonably believe you have violated these Terms, created legal or security risk, failed to pay required fees, or if we discontinue the Service or a portion of it. You may stop using the Service at any time and may request account deletion or cancellation through available account tools, your billing platform, or by contacting us. Provisions that by their nature should survive termination will survive, including provisions relating to payments due, intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.

11. Changes to These Terms

We may modify these Terms from time to time. When required, we will provide notice of material changes through the Service, on our website, by email, or through the applicable billing platform. The updated Terms will become effective on the stated effective date. If you continue to use the Service after that date, you agree to the revised Terms. If you do not agree, you must stop using the Service.

12. Governing Law and Disputes

These Terms and any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be governed by the laws of Hong Kong, without regard to conflict of law principles, except to the extent otherwise required by applicable consumer protection law. Before filing a formal claim, you agree to contact us and attempt to resolve the dispute informally. Nothing in these Terms limits rights that cannot be waived under applicable law.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
